By accessing or using AssetWorthIQ ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older.

2. Description of Service

AssetWorthIQ is an AI-powered asset valuation platform that provides estimated values for items based on photo analysis and market data. The Service uses:

• Google Gemini AI for image recognition and item identification
• eBay Browse API for real-time market pricing data
• Proprietary algorithms to generate estimated valuations

All valuations are estimates only and may vary significantly from actual market value or professional appraisal results.

3. Account Responsibilities

When you create an account with us, you are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current information

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Payment Terms

AssetWorthIQ offers subscription-based pricing with the following terms:

• Subscriptions are billed as one-time purchases for the selected tier
• All prices are in USD and charged via Stripe payment processing
• 7-Day Money-Back Guarantee: Full refund available if requested within 7 days of purchase
• No refunds after 7-day window except as required by law
• We reserve the right to modify pricing with 30 days' notice to existing subscribers

To request a refund within the 7-day window, contact support@assetworthiq.com with your order details.

5. Acceptable Use

You agree NOT to use the Service to:

• Upload illegal, harmful, or offensive content
• Violate any intellectual property rights
• Harass, abuse, or harm others
• Attempt to reverse-engineer or scrape the Service
• Use automated systems (bots) without permission
• Resell or redistribute access to the Service
• Upload content containing personal information of others without consent

Violation of these terms may result in immediate account termination without refund.

6. Intellectual Property

Your Content: You retain all ownership rights to photos and data you upload to AssetWorthIQ. By using the Service, you grant us a limited license to:

• Process your photos for valuation purposes
• Store your data securely in Firebase Cloud Storage
• Use anonymized, aggregated data to improve AI model accuracy

Our Content: The Service, including its design, features, algorithms, and branding, is owned by AssetWorthIQ and protected by copyright, trademark, and other laws.

AI Training: We may use anonymized, de-identified data (with all personal information removed) to improve our AI models. Individual photos are never shared publicly or used for marketing without explicit consent.

7. Limitation of Liability

To the maximum extent permitted by law:

• AssetWorthIQ is provided "AS IS" without warranties of any kind
• We do not guarantee accuracy, completeness, or reliability of valuations
• We are not liable for decisions made based on our valuations
• Our total liability is limited to the amount you paid for the Service in the past 12 months
• We are not liable for indirect, incidental, or consequential damages

You acknowledge that you use the Service at your own risk and that valuations are estimates only.

8. Termination

We reserve the right to suspend or terminate your access to the Service:

• For violation of these Terms of Service
• For fraudulent or abusive behavior
• If required by law or legal process
• At our sole discretion with or without notice

You may terminate your account at any time by contacting support@assetworthiq.com. Upon termination, your data will be deleted within 30 days as described in our Privacy Policy.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of British Columbia, Canada. You consent to the exclusive jurisdiction of these courts.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the modified Terms.
